Hong Kong’s employment laws follow simple, logical rules. By understanding the 5 main phases of a contract under the Employment Ordinance (Cap. 57) and Immigration Department (Cap. 115) policies, you can calculate final payouts accurately, protect your household, and stay fully compliant.



Phase 1: Contract Start Dates & Routine Payroll Setup

  • Overseas Recruits (Clause 2A): The contract starts the moment your helper arrives in Hong Kong. Full wage and legal obligations become active the exact hour she clears airport immigration.

  • Renewals with the Same Employer (Clause 2B): If you renew a contract and defer home leave, the new contract starts on the day immediately after the old contract expires.

  • Local Transfers (Clause 2C): When hiring a helper locally who is transferring from another employer, the contract starts on the exact start date approved by the Director of Immigration.


The Legal Reality: There Is No Probation Period

Once any of the three start triggers occur, there is zero probation period in Hong Kong law. Clause 10 of the standard ID407 contract takes full effect right away. Ending the contract at any point—even during the first week—requires 1 month's written notice or 1 month's salary in lieu of notice. Your legal duties begin on the official start date, not when the helper physically moves into your home.


Canceling Before the Start Date

If either party cancels after signing Form ID407 but before the official start date, standard statutory notice pay (1 month's salary) does not apply under Cap. 57. However, because signing Form ID407 is a legally binding contract, backing out creates a breach of contract under common law. The party who backs out remains responsible for actual out-of-pocket financial losses caused by the cancellation.

  • Proof of Loss: You cannot demand a flat penalty. You must show clear receipts or invoices proving direct financial losses.

Setting Up Your Monthly Payroll

Since a helper rarely starts on the first day of a calendar month, their standard working month runs from their arrival date to the day before that same date in the next month (e.g., 15 October to 14 November).

You have two choices for handling monthly salary payments:

  1. The Alignment Option (Prorating): Pay partial wages at the end of the first partial month using [Formula A] for the exact days worked. This aligns all future paydays neatly with standard calendar months.

  2. The Anniversary Option: Skip partial math entirely and pay the full monthly salary on the recurring monthly anniversary of the start date.



Phase 2: The First 3 Months (Key Milestones)

Key entitlements unlock based on completed calendar months of service, not raw day counters.

  • Paid Statutory Holidays (First 3 Months): During the first 3 months of continuous service, your helper is entitled to take statutory holidays, but they are unpaid. Once the 3-month continuous service milestone is reached, all future statutory holidays must be fully paid (Cap. 57 s.39).

  • Annual Leave Accrual: Under Section 41AA of the Employment Ordinance, if a contract ends before a helper completes 3 months of service in a leave year, no annual leave payout is owed for that year (0 days). Passing the 3-month mark unlocks pro-rata annual leave payouts.



Phase 3: Contract Renewal & Leave Year Shifts

Because employment is continuous, home leave gaps between contracts do not pause total service time. However, home leave timing can shift statutory leave tracking windows:

  • Scenario A: Home Leave Taken Immediately at Renewal: Contract 2’s start date is delayed by the home leave trip. However, Leave Year 3 opens immediately when Contract 1 expires. This gap creates a permanent shift between your helper's leave year and their contract start date. The 3-month rule resets for the new leave year during this time.

  • Scenario B: Contract Renewal with Deferred Home Leave: Contract 2 starts the day after Contract 1 ends. Service years and leave calculations roll forward without interruption.
